A utility patent is the standard patent for inventions. In the US, plants, seeds, plant parts, genetic traits and methods of breeding or processing can all be claimed in utility patents if the claimed invention is new, useful and not obvious. Protection generally lasts 20 years from filing.

In practice

Utility patents can be broader than plant patents: a claim might cover any plant with a defined trait or chemical profile, not just one clone. Cannabis utility patents exist and are public records. Their scope is often tested only if challenged, and prior art, meaning earlier public disclosure, is one way claims are limited.

This is why GenetixBay's documentation matters: dated, public records of lines, traits and chemistry can serve as prior art. Present patent records factually; do not speculate about any holder's motives.

Rules differ by country, state, province and city, and change often. This is a general definition, not legal advice: check local rules.

Don't confuse with

  • Plant patent: limited to one asexually reproduced variety.
  • Plant variety protection: breeders' rights with a breeder's exemption for research.
